What’s Legal in Kink Art?

Recommended Posts

I hear where you're coming from, I'm not a fan of that either but it isn't necessarily a crime. More so if the artist adds a disclaimer on no real world representation, coincidence is exactly what it is.
I believe ALL hand drawn art, no matter how grotesque or taboo the subject is, are covered by the First Amendment. Even likenesses of real people.
Generally legality comes down to whether the person's depicted in the imagery consented to capture and distribution, if they were okay with the art being made, that is half, they need to be okay with it being shared, posted, advertised. There is no restriction art wise for what is being depicted in it, including crimes. Not ideal if it is an actual crime, could be requested as evidence in case of a trial. If someone is unknowingly depicted, it could end up causing a civil suit for defamation.
I draw/***t nude portraits for people consent and approval are a must
These are all great to hear from the community, I don’t depict *** in my cartoons, just pretty fictional females tied up.
Ok fine, but you know I'm vain so I need guarantees:
1. During the shoot the environment has to be no lower than 82° F (I want him to be floppin not turtle ***king)
2. No *** in my mouth this time. Stained my teeth and tasted like ***. (I don't want my conditioned stimuli responses to be redefined.)
3. If I were to die or become incompacitated for any length of time longer than 3 days, immediately go to my apartment and light everything in my bedroom on fire before my mother gets there!!!
Okieee thanx, I'll have my people get ahold of your people with contracts.
I would say whatever you're comfortable with. Tbh it's better to have the art than sometimes the reality of what people want.
Surprised I didn't see the implied intent factoring into the responses.
It's sketchy territory, certainly, and depends on how they regard the "ex" in question.
Wouldn't muck with anyone's likeness that can be used to pursue malicious purposes.
Have you ***ted the all time classic of a woman tied upon the railroad tracks?
Its art, its an expression. Don't think much of it will be illegal. Lots of taboo areas, personal i think using someone's likeness (unless they fully understand and consent) is a bad idea.
Sexual explicit images of *** and *** people, im sure that's going to be illegal.
But after that legally I think your good. See some weird stuff out there, and someone's got to like it. Not really my idea of art.
A good judgment will be your comfortable, if you feel uneasy, then don't do it.
It is often a grey area that is often brought up in the anime community as well iykyk
Art is art. Is t there naked men with small wieners in a cathedral? Just no kids, imo

Some laws vary by territory and generally speaking if there is something you're uncomfortable with. Don't do it. If it's something you're comfortable with, but unsure on - then honestly it's best to speak to a legal professional than a forum

A lot of stuff I know is legal but weird.   If it was fan art of a celebrity nude and showing feet then legal but weird.

Even if it was something like someone's ex in a sexually humiliating position - you may well be fair to draw it, though if they then uploaded it somewhere - the person depicted could have a case depending on 'revenge porn' laws in that territory even though it's a drawing not a photo.
