CNC? do you use contracts or not?

Recommended Posts

This gets brought up a lot.

Contracts do NOT hold up in court, they aren't, haven't been, and likely won't ever be legal. Not only will they not protect you, in worst case, they'll be part of the evidence that proves you guilty.

Interesting… why dont they hold up in court? If nothing else it is proof of intent and agreement

Won’t hold up in many places because it’s illegal in the first place but also what if she changed her mind (safe word needed) but he didn’t stop. It’s a he said she said.
I love to play a brat with my husband like I’m mad half way through so he will be more ***ful. Pin me and really exert his power. It feels good to be wanted so deeply. It’s intoxicating. But if it’s someone outside the relationship, I’d be careful if I were the guy.

A contract would not mean a thing if they decided to take legal action which is why it is so so important to know and trust the people you engage in any sort of cnc play, this goes for impact play aswell and many other forms of play within BDSM

short answer

you can't consent to waive away your rights to have the law broken

Any decent court would find it void.

slightly longer

consent can be withdrawn at any time.  Including after a contract is drawn.

Always have a safe word! And there is absolutely no further actions of the role play action taken afterwards

Because you cannot legally consent to being the victim of something. Intent does not matter, and in many places, even if the "victim" doesn't want to pursue charges, the state still can.

In the eyes of a courtroom, there is no legal consent to be ***ed in any way. *** is a crime, and it's *** to them regardless of whether or not you asked or consented. Obvious exceptions apply for contact sports (to a degree, it's not impossible to *** someone while in a boxing match for instance). Sport is also very different because it's a regulated industry, your bedroom is not.

I'm no lawyer or attorney, but law gets complicated fast and it often doesn't work the way people think it does/should, just know a contract absolutely will not protect you in court. Many actual attorneys have answered this question the same way the 10 million times it's come up over the last decade.

I got girls to take video messages before and after the fact..

this is something else which offers no real proof or protection

there was a fairly famous case a few years ago where women were being made to do this and it was being used as a form of silencing technique

So the before videos were deliberately vague - almost leaning on that in order for it to work there had to be an element of surprise.  The after videos were generally done under ***, in these cases a kinda "you have to make these or you don't get paid"

So like, here is the question. What would you do if the lady refused to do an AFTER video...?  If she said "No, I'm not going on camera and saying I was happy - because I was not happy" then what do you do?  The fact you are relying on these videos meant you never had the right level of trust to begin with

I have always wanted to do CNC never have. However, I have done contracts with knife play/stream whipping etc. I’d say always better safe then sorry and if I do get to do a legit CNC I’d definitely want it in writing to cover us both
